New Mexico Medical Treatment: What you need to know

There are no state laws requiring employers to have a clinic at the worksite or to keep a doctor or nurse on call to treat workplace injuries. However, the New Mexico health and safety code, which is identical to the federal Occupational Safety and Health Act, requires every private and public sector employer to ensure that medical personnel are readily available for advice and consultation and that when an infirmary, clinic, or hospital is not within close proximity to the workplace, there is an individual (or individuals) who are adequately trained to administer first aid. Employers are responsible for making decisions about the details of emergency medical care in their workplaces, depending upon the size, the kinds of hazards present, the history of accidents, and the costs of various options (NM Stat. Sec. 50-9-1et seq.).

Under New Mexico's workers' compensation laws, employers must provide whatever treatment is necessary for workers injured on the job, including medical, surgical, nursing, and hospital services. Workers' compensation pays the costs of treatment without limitation.
Some states have laws that require private employers to grant employees time off for serious illness, the birth or adoption of a child, or to care for a family member with a serious illness, but New Mexico does not have such a law. New Mexico employers with 50 or more employees are covered by the federal Family and Medical Leave Act (FMLA). The law allows eligible employees to take up to 12 workweeks of leave during any 12-month period ...
