Tennessee OSHA: What you need to know

The federal Occupational Safety and Health Act (OSH Act) is “preemptive”; that is, it overrides state laws and regulations in the areas that it covers. Since it covers virtually all areas of workplace health and safety in the private sector, it supplants most state work safety requirements. Under the OSH Act, individual states may devise and administer their own standards, but only with federal approval, and only if the applicable state requirements are as stringent as the corresponding federal standards.

Tennessee is among the “state plan” states, which means it has received federal approval for its state regulatory program, the Tennessee Occupational Safety and Health Act (TN Code Sec. 50-3-101et seq.; TN Rules and Regs. Sec. 0800-01-01-.01et seq.), governing both private and public (state, county, and local government agencies, commissions, and boards) sector workplaces. The Act is administered by the Tennessee Department of Labor and Workforce Development/Division of Occupational Safety and Health Administration (TOSHA). Tennessee has adopted many of the federal standards by reference, and has adopted additional requirements that are stricter than federal rules for bloodborne pathogens, permissible exposure limits (PELs) for hazardous air contaminants, hazard communication (worker right to know), and injury and illness recordkeeping for public sector workplaces.
