Illinois MSDS : What you need to know

· Rules. Illinois follows the federal community right-to-know requirements, including material safety data sheets (MSDSs).

Private sector employers (businesses and nonprofit organizations) in Illinois are governed by federal hazard communication, or worker “right-to-know” requirements. Illinois has a federally approved occupational safety and health regulatory program for public sector (state and local government offices and operations) employers. The state has adopted the MSDS requirements of the federal hazard communication rule by reference. · Administration and enforcement. SERC implements Illinois’s community right-to-know requirements, with some administration delegated to LEPCs. OSHA administers and enforces workplace health and safety, including MSDS requirements, in the private sector. IDOL administers and enforces workplace health and safety MSDS requirements for public sector employers.

Facilities in Illinois required to prepare or have available MSDSs for hazardous chemicals must submit an MSDS for each chemical, or a list of all chemicals, to IEMA’s Hazardous Materials Compliance and Enforcement section, and the LEPCs and local fire departments as required under the federal rules.
