Indiana MSDS : What you need to know

· Rules. Indiana follows the federal community right-to-know program reporting requirements, including MSDS or chemical list submission requirements for each chemical manufactured, used, or stored above the minimum thresholds. Owners and operators of automobile refinishing facilities, degreasing operations, and surface coating operations must maintain MSDSs for the chemicals at the source of emission.

Indiana is a "state plan" state; that is, it has its own federally-approved occupational safety and health regulatory program. The state has adopted the standards of the U.S. Occupational Safety and Health Act (OSH Act) entirely, including MSDS requirements, so the state requirements are identical to the federal. · Administration and enforcement. IDEM and IERC jointly administer and enforce the community right-to-know rules in Indiana; IERC receives MSDSs or chemical lists from employers. IDEM administers and enforces the MSDS recordkeeping requirements for all air emissions sources. DOL administers and enforces IOSHA, including MSDS requirements, in both the private and public sector workplaces.

DEGREASING OPERATIONS
326 IAC 2-9-12

An owner or operator of a degreasing operation that has been issued an operating agreement by IDEM must keep MSDSs for all degreasing solvents at the source of emission.

REFINISHING FACILITIES
326 IAC 8-10-9

Owners or operators of automobile refinishing facilities must maintain MSDSs or product or other data sheets for at least 3 years following use of the product.
