Kentucky MSDS : What you need to know

Hot mix asphalt plants must keep MSDSs with fuel usage logs.

Kentucky is a “state plan” state; that is, it has its own federally approved occupational safety and health regulatory program. KY OSH governs both public (state, county, and local governments) and private (private businesses and nonprofit organizations) sector workplaces, except for the Tennessee Valley Authority and federal facilities. The state has adopted the federal workplace safety and health rules, including those for MSDS management, by reference.

· Administration and enforcement. DEP, KyERC, and EPA share responsibility for the administration and enforcement of the EPCRA requirements in Kentucky. DEP administers MSDS requirements for hot mix asphalt plants. OSH Compliance administers and enforces workplace safety and health, including MSDS requirements, in both private and public sector workplaces.
