Maryland MSDS : What you need to know

· Rules. Maryland follows the federal rules for chemical reporting under community right-to-know, and added its own requirements for supplying copies of material safety data sheets (MSDSs) to certain individuals and community groups. The state has adopted its own pesticide notification rule that requires schools to provide certain individuals with access to MSDSs for pesticides applied at school.

Maryland is a "state plan" state; that is, it has its own federally approved workplace safety and health regulatory program. The Maryland Occupational Safety and Health Act governs MSDS requirements in both the public and private sectors. The state has adopted the standards of the federal OSH Act and added rules that are stricter than federal rules for employee access to MSDSs and MSDS obligations of independent contractors.

· Administration and enforcement. MDE administers the community right-to-know reporting requirements. DOA administers the pesticide applicator MSDS notification requirements. MDLLR administers and enforces workplace health, including MSDS compliance, in both the private (businesses and nonprofit organizations) and public sector (state and municipal governments, school, commissions, etc.) workplaces.

On written request to MDE, the following individuals and groups may have access to, inspect, and make a copy, at the person's expense, of any chemical information list and MSDS that contains information on hazardous or toxic chemicals and that MDE maintains:
