Montana MSDS : What you need to know

· Rules. Montana follows the federal community right-to-know rules for material safety data sheets. See the national section MATERIAL SAFETY DATA SHEET for more information. Permanent pesticide storage facilities must include MSDSs with spill response plans for each pesticide stored at the facility.

Montana is not a "state plan" state; that is, it does not have a federally approved occupational safety and health regulatory program. Consequently, the federal OSH Act governs MSDS requirements in the private sector workplace. The state does have a toxic substance worker "right-to-know" law, ECHCIA, that governs MSDS requirements in the public sector workplace. ECHCIA contains MSDS provisions for public sector workplaces that are stricter than federal requirements.

· Administration and enforcement. DEQ administers and enforces the community right-to-know reporting requirements in Montana. MDA administers the pesticide storage facility requirements. OSHA administers and enforces workplace health and safety requirements, including MSDS requirements, in the private sector. DLI administers and enforces workplace safety and health rules, including those for MSDSs, in the public sector workplace.
