New Hampshire MSDS : What you need to know

· Rules. New Hampshire follows the federal hazardous chemical community right-to-know rules for chemical list and MSDS reporting to LEPCs and local fire departments. The state has adopted MSDS reporting and recordkeeping requirements that are stricter than federal standards for air emissions sources, cold cleaning operations, and hazardous waste delisting.

New Hampshire is not a "state plan" state; that is, it does not have a federally approved occupational safety and health regulatory program. Therefore, the federal OSH Act governs private sector occupational safety and health, including material safety data sheet (MSDS) requirements. Public sector employers in New Hampshire must comply with the MSDS requirements of the New Hampshire Workers' Right-to-Know Act, which mirror federal requirements, except for additional requirements for posting a notice of the availability of MSDSs and that an employee may refuse to work with a chemical until an MSDS is provided. · Administration and enforcement. OEM administers the hazardous materials community right-to-know requirements. DES administers the air emissions source, cold cleaning operations, and hazardous waste delisting requirements. OSHA administers and enforces private sector occupational safety and health, including MSDS requirements. NHDOL administers and enforces MSDS requirements in the public sector workplace.
