North Carolina MSDS : What you need to know

· Rules. Because North Carolina is a "state plan" state-that is, it has a federally approved job safety and health plan, the North Carolina Occupational Safety and Health Act governs workplace material safety data sheet (MSDS) requirements in both the public and private sector. The state has adopted by reference the federal workplace hazard communication standard, including its MSDS regulations.

The state has adopted the federal requirements for community right-to-know requirements. There are state MSDS requirements for CCPs that are stricter than federal rules.

There are state MSDS requirements for coal combustion products (CCPs) and for the contents of a pesticide registration submittal that are stricter than federal rules. See the state section PESTICIDES for more information about registration.

· Administration and enforcement. DENR administers the state’s CCP rules related to wastewater treatment. DACS administers the rules for pesticide registration. DOL administers and enforces workplace safety and health, including MSDS compliance, in both the public and private sector workplaces. SERC administers the community right-to-know requirements.
