Oregon MSDS : What you need to know

COMPARISON: STATE VS. FEDERAL

The state follows federal community right-to-know requirements for providing safety data sheets (SDSs) to federal, state, or local authorities, and includes a provision for retaining SDSs for a listed hazardous chemical. The state’s solid waste permit and oil spill contingency rules contain SDS requirements that are stricter than federal rules.

Oregon is a “state plan” state; that is, it has its own federally approved occupational safety and health regulatory program. The state has adopted by reference the federal workplace Hazard Communication Standard, including its SDS provisions.

Agricultural employers must provide hand-laborers with an information brochure in addition to SDSs.

The Oregon Department of Consumer and Business Services’ Oregon Occupational Safety and Health Division (OR-OSHA) enforces all workplace requirements for hazard communication for public and private sector employers in general industry, construction, and agricultural activities in the state. The Oregon Department of Environmental Quality (DEQ) administers the solid waste and oil spill contingency programs. The Office of the State Fire Marshal (OSFM) administers and enforces Oregon’s community right-to-know program. Oregon Emergency Management (OEM) coordinates hazardous materials planning requirements and serves as the point of contact for the Oregon Interagency Hazard Communication Council/Oregon State Emergency Response Commission (SERC) and local emergency planning committees.
