Pennsylvania MSDS : What you need to know

· Rules. Pennsylvania follows the federal community right-to-know rules for hazardous chemical reporting by private (private business and nonprofit organizations) sector employers. The state has also adopted state community right-to-know requirements for chemical reporting with MSDSs that are stricter than federal reporting requirements for both private and public (state and local government operations, school districts, commissions) sector employers.

Pennsylvania does not have a federally approved workplace safety and health regulatory program; therefore, federal rules govern all workplace safety and health requirements for private sector employers.

Public sector employers must comply with the state workplace safety and health MSDS requirements of the Pennsylvania Worker and Community Right-to-Know Act. Pennsylvania’s MSDS informational requirements for the public sector are stricter than federal requirements. · Administration and enforcement. DOLI administers and enforces the MSDS rules for all facilities that must report under community right-to-know rules. LEPCs also have been delegated responsibility for handling local implementation of the community right-to-know rules. OSHA administers the federal rules for worker safety and health in the private sector. DOLI administers and enforces the MSDS requirements under public sector worker safety and health rules.
