Arizona Smoking: What you need to know

The Smoke-Free Arizona Act prohibits smoking in most indoor public places and workplaces (AZ Rev. Stat. Sec. 36-601).

Workplaces. The Act prohibits smoking in all enclosed public places and workplaces with one or more employees, whether compensated or volunteer. Included in the ban are work areas, offices, restrooms, conference and meeting rooms, lunchrooms and employee lounges, hallways and stairways, elevators, and employer-owned vehicles operated or driven during work hours and occupied by more than one person.

Public places. Public places covered by the ban include airports, banks, bars, common areas of multifamily housing units, schools and educational facilities, healthcare facilities, public transportation facilities, food stores and restaurants, retail stores and shopping malls, sports facilities, auditoriums and theaters, common areas of hotels and motels, and public areas of multiple unit residential facilities.

Outdoor entrance buffer zones. Smoking is not permitted within 20 feet of entrances to businesses or places of employment, open windows, air intakes, or ventilation systems. Ashtrays and smoking receptacles must be removed from this area. Emergency exits and doorways to outdoor patios are exempted. Note: Business proprietors are liable only for areas under their control and are not liable for smoking on public sidewalks.

Outdoor patios. Outdoor patios may be designated as smoking permitted if they are under control of the proprietor, have one open side (which may have a railing or be covered by permeable cloth), and not be near air intakes, open windows, or other ways for smoke to enter an indoor area.
