Louisiana Smoking: What you need to know

The Louisiana Smoke-Free Air Act prohibits smoking in any public building, enclosed place of employment with more than one worker; schools, school grounds, and school buses; healthcare facilities; stores and malls; indoor sports arenas and theaters; banks; hotel and motel lobbies; restaurants and bars within or attached to restaurants; and eating areas within casinos (LA Rev. Stat. Sec. 40:1300.251 et seq.).

Exceptions. The Act does not apply to:

  • Outdoor areas of places of employment
  • Private homes and vehicles when not used for licensed child care or day care
  • Freestanding bars that do not allow or employ anyone under the age of 21
  • Casino gaming areas
  • Tobacco retail, wholesale, distribution, or storage businesses
  • Cigar bars
  • Up to 50 percent of hotel and motel rooms
  • Private limousines for hire
  • Facilities when used for carnival balls and conventions and trade shows not open to the public

Employer responsibilities. Employers must post no-smoking signs and remove all ashtrays from their premises. Employers that violate provisions of the Act will be fined up to $500 per violation.

Local Ordinances

Any municipal or parish governing authority or other political subdivision of the state may enact a more stringent ordinance than the Louisiana statute.

Employers may not discriminate against applicants or employees on the basis of their off-duty smoking or require as a condition of employment that an employee not smoke (LA Rev. Stat. Sec. 23:966).
