New Hampshire Smoking: What you need to know

The New Hampshire Indoor Smoking Act regulates and restricts smoking in all public and private enclosed workplaces with four or more workers or volunteers and in places of public access, including public conveyances and tramways and gondolas.

Under the Act, smoking is prohibited in elevators, public educational buildings and grounds, childcare facilities (during hours of operation if home-based), hospitals and acute-care facilities, and sales floors in grocery stores.

Smoking is also prohibited in restaurants; cocktail lounges; bars, including those within resorts, hotels, and motels; and enclosed places owned and operated by social, fraternal, or religious organizations when open to the general public.

Smoking may not be allowed where it is prohibited because of fire protection, safety, or sanitation concerns. Under the Act, the person in charge may declare any facility to be entirely nonsmoking (NH Rev. Stat. Sec. 155:64et seq.).

Exemptions. Exempt from the law's restrictions are: privately rented public conveyances; cigar bars, buildings owned and operated by social, fraternal, or religious groups when used solely by their membership; guest rooms of any publicly accessible building, or rooms of hotels and motels when rented privately; postsecondary dormitory rooms; residence rooms in nursing homes, prisons, and rehab facilities; healthcare facilities other than hospitals and acute-care facilities; and rooms of patients with extraordinary medical conditions, psychiatric disorders, or alcohol and drug withdrawal programs, provided the patient's physician has written an order allowing the person to smoke.
