Rules. Virginia is a "state-plan" state; that is, it has a federally approved occupational safety and health regulatory program in both the public and private sectors. The VOSH Act has adopted the standards and rules of the federal Occupational Safety and Health Act (OSH Act), and includes its own additional rules for penalties.

OSHA: Violation of the safety and health rules by an employer Administrative:VCA 40.1-49.4(A):Penalty amount to be determined by DOLI, not to exceed OSHA civil limitations
OSHA: Violation of the safety and health rules by an employer that results in the death of an employee Criminal:VCA 40.1-49.4(K):Up to $70,000 and/or up to 6 months' imprisonment; up to $140,000 and/or 1 year's imprisonment for subsequent violation
DISCUSSION

Virginia has a federally approved occupational safety and health regulatory program in both the public and private sectors. The VOSH Act has adopted the standards and rules of the federal Occupational Safety and Health Act (OSH Act), and includes its own additional rules for penalties.
