Maryland has adopted the federal requirements for workplace recordkeeping for injury and illness reports and employee medical records by reference (COMAR 09.12.21.01 to 09.12.21.10 and COMAR 09.12.31). Public sector (state and local government offices and operations) employers in Maryland may apply for a variance from the recordkeeping rules (COMAR 09.12.21.04).

Employers must report any accident resulting in one or more fatalities or the hospitalization of three or more employees to the nearest regulatory agency office within eight hours of either the occurrence or the time it became known to any agent of the employer by calling 410-767-7233.
