Michigan Illness and Injuries: What you need to know

Michigan's workplace recordkeeping requirements for illnesses and injuries mirror federal requirements (MAC r. 408.22101 to 408.22162). The state requirements for maintenance of employee medical records mirror federal requirements (MAC r. 325.3451 to 325.3476). Employers may use the illness and injury recordkeeping forms developed by the state.

Reporting fatalities and multiple hospitalizations. The state has adopted the federal reporting requirements for workplace fatalities and when three or more workers are hospitalized. Employers must report such incidents in person or by phone at 800-858-0397.

The Michigan Department of Labor and Economic Growth/Occupational Safety and Health Administration (MIOSHA) administers and enforces workplace safety and health standards.

The following MIOSHA reporting forms, or equivalent forms, may be used in place of the corresponding federal forms:

  • MIOSHA Form 300 Log of Work-Related Injuries and Illnesses
  • MIOSHA Form 301 Injury and Illness Incidence Report
  • MIOSHA Form 300A Summary for Work-Related Injuries and Illnesses

Businesses that submit illness and injury reports to MIOSHA may use the Employer's Basic Report of Injury form (BWC-100) in lieu of the MIOSHA 301 Injury and Illness Incidence Report. Contact your workers' compensation insurance carrier to order large quantities of the BWC-100 forms.

Use the Supplemental Report of Fatal Injury (BWC-106) to report a death.
