On December 1, 2006, new federal rules went into effect that affect the retention and production of electronically stored information during the discovery phase of lawsuits filed in federal court. The new rules, which set guidelines for sharing electronic information during the litigation process, will almost certainly change the way you preserve data.

The new rules require preservation of electronic evidence not just during a lawsuit, but also when litigation is merely anticipated. Electronically stored information resides in many places - laptop and desktop computers, network servers, and personal digital assistants - just to name a few. Your duty to preserve and retrieve data applies even if the device is in someone else’s control, like an employee or a contractor. Plus, the duty to preserve evidence applies even if the information isn’t accessible or reasonable to produce.
