Under Oklahoma law, jurors must be reinstated to their same position at the completion of jury duty. It is illegal to discharge or discipline an employee for taking time off to serve as a juror provided that the employee notifies his or her employer within a reasonable period of time after receipt of the jury summons.
It is also illegal to require or request an employee to use sick, annual, or vacation time when serving as a juror. However, an employee may decide on his or her own volition to use paid time leave for this absence. Violation of this law is punishable by fine. In addition, discharged employees may sue the employer for actual and punitive damages (OK Stat. Tit. 38 Sec. 34 and Sec. 35).
Courts are required to automatically postpone and reschedule the service of a summoned juror who works for an employer with five or fewer full-time employees, or their equivalent, if another employee has previously been summoned to appear during the same period.
