Several forms of employment are excepted from the state minimum wage law, including (KY Rev. Stat. Sec. 337.010; KY Rev. Stat. Sec. 337.275):
• Agricultural employees
• Individuals employed in a bona fide executive, administrative, supervisory, or professional capacity
• Outside salespeople and collectors
• Employees of the federal government
• Domestic employees in private homes
• Employees of retail stores, restaurants, hotels, motels, and other service establishments with gross annual income of less than $95,000 for the preceding 5 years
• Babysitters and live-in companions to sick or elderly people
• Newspaper carriers
• Employees of nonprofit seasonal camps and conference centers
• Individuals certified by the commissioner of workplace standards as workers with a disability, sheltered workshop employees, or students
• Any employee of a third-party employer or agency providing in-home companionship services for a sick, convalescing, or elderly person
• Individuals employed to provide 24-hour residential care on the employer's premises in a parental role to children who are primarily dependent, neglected, and abused, and who are in the care of private, nonprofit childcare facilities licensed by the Cabinet for Health and Family Services
Workers with disabilities. Employees with disabilities may be employed at a wage below the applicable minimum but only with a certificate issued by Kentucky labor authorities stating the rate of pay applicable to each such worker (KY Rev. Stat. Sec. 337.010).
