North Dakota Callback/ Report-In Pay: What you need to know

Engaged to wait. Employees who are required to remain on call on the employer's premises or so nearby that they cannot use the time effectively for their own purposes are “engaged to wait” and are considered to be working. Standby time on the employer's premises is considered working time.
Waiting to be engaged. Employees who are on call and not required to remain on the employer's premises but are instead required to respond to a beeper or leave word at home or with the employer about where they can be reached are “waiting to be engaged” and are not considered to be working. Employees who are waiting to be engaged are not required to be compensated for the time (ND Admin. Rules Sec.46-02-07-01; ND Admin. Rules Sec.46-02-07-02).
