Colorado Minimum Wage: What you need to know

Under state law, if a higher minimum wage rate is established by federal law or regulations, employers must pay the higher rate (CO Rev. Stat. Sec. 8-6-106).
The Colorado Overtime and Minimum Pay Standards Order (COMPS) regulates wages, hours, working conditions, and procedures for employers and employees subject to the minimum wage law in Colorado. COMPS covers all private sector work, unless specifically exempted. Pay cannot be below the minimum wage even if it is a salary, piece rate, commission, or other basis, except minimum wages may be reduced by 15 percent for nonemancipated minors and for persons certified by the Division of Labor as less efficient due to physical disability. Fifteen percent is the maximum reduction, even if federal law permits lower wages. Pay can be reduced below the minimum for certain permitted deductions, as well. If a local government has enacted a higher minimum wage, work covered by the local minimum wage ordinance must be paid that higher wage.

The state minimum wage law does not apply to:
• Salaried professional, executive/supervisory, and administrative employees; doctors; lawyers; teachers; and employees in highly technical computer occupations paid at least $27.63 per hour
• Outside sales representatives if at least 80 percent of their work time is related to their sales
• A 20 percent owner of a company or, at a nonprofit, the highest-paid/highest-ranked employee, if he or she is actively engaged in management of the employer
• Elected officials and members of their staffs
• Companions
