Several occupations and industries are exempt from the minimum wage provisions of the Delaware law, including (DE Code Tit. 19 Sec. 902et seq.):
• Agricultural workers
• Domestic servants in private homes
• Federal government employees
• Volunteers at not-for-profit organizations
• Fishermen and processors of seafood products at sea
• Counselors under the age of 18 working for nonprofit summer camps
• Inmates participating in work-release programs
• Bona fide administrative, executive, and professional employees
• Commissioned outside salespersons
Learners, apprentices, workers with disabilities. The state Department of Labor may issue special certificates allowing employment at wages below the minimum rate for learners, apprentices, and workers with disabilities (DE Code Tit. 19 Sec. 905, Sec. 906).
Training wage. An employer may pay an employee who is 18 years of age or older, during the first 90 consecutive calendar days after the employee is hired by the employer, a wage rate up to $0.50 less than the required minimum wage rate effective January 1, 2019.
Youth wage. An employer may pay an employee who is under 18 years of age a wage rate that is up to $0.50 less than the required minimum wage rate effective January 1, 2019.
Delaware employers must post the provisions of the state minimum wage law in a conspicuous location in the workplace (DE Code Tit. 19 Sec. 908).
