District of Columbia Minimum Wage: What you need to know

The Enhanced Professional Security Amendment of 2008 requires employers to pay a security officer working in an office building in the District a certain minimum wage (DC Stat. Sec. 32-1003(h)). The combination of wages and benefits paid to a security officer must at least equal the rate established by the U.S. Secretary of Labor for the "guard 1 classification" under the Service Contract Act of 1965.
The following workers are exempt from the District's minimum wage provisions (DC Stat. Sec. 32-1002 et seq.):
• Individuals, including casual babysitters, employed in the employer's private home;
• Volunteers for educational, charitable, religious, or nonprofit organizations;
• Lay members elected or appointed to office within any religious organization and engaged in religious functions;
• Newspaper deliverers;
• Outside salespersons; and
• Executive, administrative, or professional employees.
The U.S. Department of Labor issues Fair Labor Standards Act (FLSA) regulations defining executive, administrative, and professional employees. Currently, the salary threshold for exempt employees is $455 per week, and there are duties tests to determine the exemptions for executive, administrative, professional, computer employees, and outside sales positions.
All workers with disabilities must be paid at least the minimum wage unless a certificate has been issued by the U.S. Department of Labor that authorizes the payment of a subminimum wage (DC Muni. Regs. Sec. 7-902
