Iowa Overtime: What you need to know

Iowa does not have an overtime law. However, the federal Fair Labor Standards Act (FLSA), which requires the payment of overtime in enterprises involved in interstate activities, covers all but the smallest organizations.

An employer having any employee who is covered by the FLSA must post notices outlining the federal minimum wage and overtime regulations. The notices must be posted conspicuously and in enough places so employees can see them as they enter and exit the workplace. This notice is available from the Iowa Workforce Development Office.
Filing a claim requires the completion of a Claim for Wages form by an employee. When the claim is received at the Division of Labor, it will be assigned a docket number. After the claim is docketed, the information contained on the claim is entered into the wage claim database, and a file is created for the claim. The file will be used to collect all information submitted about the claim from all involved parties. Should a claim go to court, much of this information may be entered into evidence.
After the file is created, a letter of notification is sent to the employer indicating the employee's name, the reason for the claim, and the amount being claimed. A copy of the letter is also sent to the employee. The employer also receives an Employer’s Wage Claim Response Form to complete and return within 14 days. The form contains information specific to the business, the individual's employment, and the employer’s reasons for not paying the claimed amount.
