Oklahoma Equal Pay Acts: What you need to know

Sex-based discrimination. The Oklahoma Equal Pay Act prohibits employers from willfully paying women at a rate less than the rate at which it pays men for comparable work on jobs requiring comparable skill, effort, and responsibility (OK Stat. Tit. 40 Sec. 198.1).
The Act applies to all private employers, regardless of size.

Wage differentials are permissible when based on:
• A seniority system
• A merit system
• A system that measures earnings by quantity or quality of production
• A differential based on any factor other than sex
The Oklahoma Anti-Discrimination Act prohibits employers from pay discrimination based on race, color, religion, sex, national origin, age, genetic information, or disability (OK Stat. Tit. 25 Sec. 1301 et seq.). The Act covers all public employers and private employers.
Under the Lilly Ledbetter Fair Pay Act of 2009, the federal fair employment laws were amended so that each paycheck affected by an employer's prior discriminatory practice or decision constitutes an unlawful discriminatory act that triggers a new deadline for filing a pay discrimination claim. An employee alleging discrimination must be able to show that the paycheck or other compensation was affected by a past discriminatory act.
The Oklahoma commissioner of Labor enforces the Equal Pay Act. The commissioner is authorized to investigate complaints and institute proceedings in state court to enforce the Act.
The Oklahoma Human Rights Commission enforces the Anti-Discrimination Act. Remedies include hiring, reinstatement or promotion, back pay, and legal fees.
