Delaware Notices (Posting): What you need to know

Delaware requires that all employers post several notices in the workplace informing employees of their rights and obligations under various employment laws. The notices must be placed conspicuously and in enough places to be seen easily by employees as they enter and exit the workplace and, in some cases, where they can be seen by applicants for employment as well.

Employers may download a copy of the Department of Labor's (DOL) official poster at
Breaks. Employers must post a notice describing breaks required during working hours (DE Code Tit. 19 Sec. 707).
Child labor. Employers that employ minors must post a general summary of Delaware's Child Labor Law (DE Code Tit. 19 Sec. 501et seq.).
Discrimination. Employers with four or more employees must post a notice that summarizes the Discrimination in Employment Act and complaint filing procedures, as well as a summary of the law regarding sexual harassment. The poster must be posted where employees and applicants for employment are likely to see it (DE Code Tit. 19 Sec. 716).
Electronic monitoring. Employers must provide notice of any monitoring or intercepting activity or policies regarding employees' telephone transmissions, electronic mail, or Internet usage before engaging in any such activity (DE Code Tit. 19 Sec. 705). Employers that violate this law are subject to a fine of $100 for each violation. The required notice may be provided in one of two forms:
• Electronic notice at least once during each day the employee accesses company-provided e-mail or Internet services, or
