Arkansas Jury Duty/ Court Appearance: What you need to know

Jury duty. An employer may not discharge an employee because of absence from work as a result of jury duty.
An employee may not be penalized with loss of sick leave or vacation time or subjected to any other penalty because of absence as a result of jury duty.
Employees are required to give reasonable notice to the employer if summoned for jury duty. Employers that violate this provision are guilty of a misdemeanor (AR Code Sec. 16-31-106).

Court appearance. In addition to compliance with the law regarding jury duty, public employers may not discharge or penalize an employee who serves as a witness (AR Code Sec. 21-4-213; AR Admin. Code Sec. 105.9.1).
Private employers. State law does not require private employers to pay employees for absences caused by jury duty or court appearances.
State employers. State employers are required to grant paid leave to any employee serving as a juror in state or federal court. Employees may keep any fees paid by the court. This paid leave does not count toward an employee's annual leave (AR Code Secs. 21-4-213; 21-5-104; and AR Admin. Code Sec. 105.9.1).
Employees who work night shifts are entitled to leave on the night shift of any day on which they serve (AR Admin. Code Sec. 105.9.3).
State employers are also required to grant paid leave to any employee who is subpoenaed as a witness if it regards a matter within the employee's scope of state employment.
State employers must also grant paid leave to an employee subpoenaed as a witness outside of the scope of employment so long as the employee is not serving as a paid expert witness or a party to the litigation.
