Volunteer firefighter and EMS protection. Employers are prohibited from terminating an employee who is a volunteer firefighter or emergency medical services (EMS) provider who responds to an emergency that results in loss of work.
All employers are covered by the law.
Covered emergencies include going to, attending to, or coming from a fire call; a hazardous or toxic materials spill and cleanup; any other situation to which a volunteer fire department has been dispatched; or an actual medical emergency to prevent the imminent loss of life.
Any time lost from employment may be charged against the regular compensation of the employee.
Before missing work, the employee must attempt to contact his or her employer to notify the employer that the employee has been dispatched to an emergency.
