Montana Paychecks: What you need to know

Wages defined. Wages include all amounts due for labor or service performed by an employee for which the employee has a reasonable expectation of payment. Wages may be fixed or determined by time, job, piecework, commission, or any other method. The term “wages” also includes bonuses, tips, and gratuities (MT Code Sec. 39-3-201et seq.).

Regular paydays. Employers must pay all wages no more than 10 days after the end of the pay period (this law does not apply in agriculture or stock raising). Professional, supervisory, or technical employees are paid monthly. If there is not an established payday schedule, the paydays are presumed to be semimonthly (MT Code Sec. 39-3-204).
Late time sheets. If an employee submits a time sheet after the employer's established deadline for processing time sheets for a particular time period, an employer may pay the employee the wages due in the next pay period.
Wages may be paid in cash or by check. Employers that pay their employees by check must provide for check cashing, without charge, at a bank or elsewhere.
Direct deposit. Wages may be paid to the employee by direct deposit if the employee has consented in writing or electronically to be paid in this manner and if a record is retained. However, an employee may not be required to use direct deposit as a method for payment of wages.
Payroll cards. An employee may not be required to use a payroll card as a method for payment of wages; however, employers may pay employees with payroll cards if all of the following requirements are met:
