Under the Wyoming Fair Employment Practices Act, employers may not discriminate in hiring on the basis of age (40 years or over), sex, race, creed, color, national origin, ancestry, pregnancy, qualified disability, or use of tobacco (WY Stat. Sec. 27-9-101et seq.). The Act applies to all public employers and private employers with two or more employees.
Bona fide occupational qualification (BFOQ) exception. Although a BFOQ exception is not spelled out in the law, the Wyoming Fair Employment Commission takes the position that it may be permissible in some situations to hire an individual on the basis of a BFOQ reasonably necessary to the normal operation of a particular business. Such situations are rare, however, and employers should be cautious in relying on this defense when making employment decisions.
