Comparison: State vs. Federal

Rules. The federal rules for the management of chlorofluorocarbon (CFC), hydrochlorofluorocarbons, and other ozone-depleting substances are effective in Rhode Island. In addition, Rhode Island has banned the manufacture or sale of CFC-11- or CFC-12- containing products except for products for which there are no non-CFC substitutes or products required to be purchased under a contract that predated the ban. Administration and enforcement. DEM administers and enforces the state CFC product ban laws. EPA administers and enforces the federal CFC management requirements effective in Rhode Island.

RI Gen. Laws 23-18-10-3 to 23-18-10-5

Rhode Island banned the purchase or manufacture of products containing or made with CFC-11 or CFC-12 after January 1, 1995. The DEM director may exempt an item or product if the item or product has no acceptable non-CFC-processed equivalent or the CFC ban would cause undue hardship.
