Comparison: State vs. Federal

Rules. The federal rules for the management of chlorofluorocarbon (CFC), hydrochlorofluorocarbons, and other ozone-depleting substances are effective in Texas, although the state has not incorporated the rules into its own regulations. There are no state regulations pertaining to the management of ozone-depleting substances. However, the Texas regulations governing municipal solid waste specifically state that refrigerators, freezers, air conditioners, and any other items containing the CFCs must be handled in accordance with federal requirements under 40 CFR 82.156. Administration and enforcement. The Texas Commission on Environmental Quality (TCEQ) and EPA administer and enforce the CFC management rules.
