Comparison: State vs. Federal
• Rules. No federal or Maryland state laws or regulations require environmental auditing. However, MDE encourages self-auditing as an effective environmental management technique. Under the state's Environmental Audit Policy, organizations that disclose environmental hazards to MDE, under specified requirements, may receive immunity from administrative penalties. This policy is not a statute or regulation but sets forth criteria and guidelines to be used by MDE staff in settlement of enforcement cases. Immunity is granted under the policy pursuant to MDE's enforcement discretion. In addition, MDE may require an environmental assessment of a facility as part of its enforcement policy.
