· Rules. Massachusetts DEP has adopted several policies that encourage auditing by offering penalty mitigation for certain violations that are discovered as a result of an audit. The Massachusetts Environmental Audit Policy is a general audit policy that is applicable to all regulated entities except for municipalities. The Small Business Policy supplements the Environmental Audit Policy and should be read in conjunction with it. The Municipal Policy applies to all municipal entities in Massachusetts. The Enforcement Response Guidance is a set of guiding principles, policies, and procedures for DEP to use in exercising its enforcement authority. It supplements the environmental, small business, and municipal policies.
These policies are intended solely as guidance for DEP employees in the exercise of enforcement authority and do not create rights, duties, obligations, or defenses enforceable by any person in litigation with DEP.
