Rules. Washington has not passed an environmental audit privilege law providing for reduced penalties for violations discovered as a result of an environmental audit. EPA has concerns about the potential impact of some state audit privilege and immunity laws on the ability of the states to enforce federal requirements, including those under Title V of the Clean Air Act. The state has promulgated regulations providing incentives for the self-disclosure of excess air emissions.

Administration and enforcement. EPA has published an Audit Policy, and any self-disclosures under the policy should be made to EPA Region 10. The requirements for the self-disclosure of excess air emissions are implemented and enforced by WDOE's Air Quality Program, with assistance from the local air quality agencies within their respective jurisdictions.
