Comparison: State vs. Federal
• Rules. Florida's 1991 Pollution Prevention Act provides statewide pollution prevention (P2) goals for the public sector, but does not impose any specific requirements to meet these goals. All state agencies, the state university system, community colleges, and all municipalities, counties, regional agencies, and special districts are required to develop and implement strategies to prevent pollution, including public information programs and education programs.
However, both the public and private sectors must comply with federal pollution prevention requirements in Florida. These federal requirements are described in the national section POLLUTION PREVENTION.
• Administration and enforcement. DEP's Division of Waste Management administers and enforces Florida's P2 program.
The goal of Florida's P2 program is to increase the use of multimedia pollution prevention as the preferred method of reducing pollution from industrial processes. The program provides information and assistance to meet this goal. Further, P2 strategies and practices often put a facility ahead of the regulatory curve exceeding current regulations and preparing for future regulatory standards.
