Comparison: State vs. Federal

Rules. Both the state and federal pollution prevention (P2) rules must be complied with in Pennsylvania. The federal P2 requirements are described in the national section POLLUTION PREVENTION. The Department of Environmental Protection (DEP) may require a person to submit a report or plan for their P2 activities when pollutants and water resources are involved.

Administration and enforcement. DEP administers both the federal and state P2 requirements in Pennsylvania.

State Requirements


25 Pa. Code 91.34

With respect to the protection of water resources, DEP may require a person to submit a report or plan for their P2 activities and encourages the use of P2 measures that minimize or eliminate the generation of pollutants over measures that involve pollutant handling or treatment. DEP encourages consideration of the following P2 measures, in descending order of preference, for environmental management of wastes:

  • Reuse
  • Recycling
  • Treatment and disposal

Persons engaged in activities related to the impoundment, production, processing, transportation, storage, use, application, or disposal of pollutants must take necessary measures to prevent the substances from directly or indirectly reaching state waters (25 Pa.
