Comparison: State vs. Federal
• Rules. Kansas generally follows the federal oil release reporting guidelines and has incorporated by reference federal UST release reporting requirements under 40 CFR 280.50 to 280.53. In addition to the requirement that releases of 25 gallons or more on the surface of the ground and spills that cause a visible sheen on the surface water be reported, a spill in any amount that occurs underground must be reported. Kansas has also established a petroleum storage tank release trust fund to pay for releases from underground and aboveground storage tanks (KAR 28-44-18).
