Comparison: State vs. Federal
• Rules. Montana has established a spill reporting policy under the state Water Quality Act. Montana requires that all releases or spills of hazardous or deleterious substances or other wastes, regardless of size, be properly and quickly managed, contained, and removed. Montana's UST spill program follows the federal program except that it covers additional types of tanks and contains several more stringent requirements. In the event of a reportable release, facility personnel should call NRC, as well as DES or DEQ. See the state section RELEASE NOTIFICATION for a review of general and federal leak detection requirements.
