Comparison: State vs. Federal
• Rules. New Jersey has developed its own state-specific spill prevention plan regulations that are in addition to the federal Spill Prevention, Control, and Countermeasure (SPCC) requirements. The state regulations apply to "major facilities" in the state, and require that two plans be submitted—a Discharge Prevention, Containment, and Countermeasure (DPCC) plan and a Discharge Cleanup and Removal (DCR) plan—to the New Jersey Department of Environmental Protection's (DEP) Bureau of Release Prevention. Regulated facilities must also create an employee training program.

• Administration and enforcement. DEP's Bureau of Release Prevention is responsible for the administration and enforcement of the state's spill prevention plan requirements. EPA Region 2 administers and enforces the SPCC regulations in the state.
