• Rules. As with federal law, Maryland allows certain information to be considered confidential and protected from disclosure when being submitted to MDE as a condition of a permit or regulation. Maryland has specific rules for the disclosure of confidential information to medical personnel. See the national section COMMUNITY RIGHT-TO-KNOW for additional information. Contact the specific branch of the agency to which information is submitted for specific procedures that may have to be followed to maintain confidential treatment of information.
All or part of an environmental audit may be protected under attorney-client privilege laws. The attorney-client privilege applies to the confidential communication made by a client to his or her attorney acting as a legal advisor and made for the purpose of obtaining legal advice on some right or obligation. The purpose of the privilege is to allow a client to confide in his or her attorney, secure in the knowledge that the communication will not be disclosed.
