· Rules. North Dakota does not have an OSHA-approved regulatory program. Therefore, North Dakota follows federal safety and health program requirements for hazard communication for all private sector employees.
North Dakota has adopted by reference the federal general industry and construction standards, including HCS, for public sector employers.
· Administration and enforcement. OSHA administers and enforces the HCS requirements for private sector employers in North Dakota. WSI administers and enforces the HCS requirements for public sector employers.
