Rules. New Hampshire has state brownfields statutes and regulations that encourage the voluntary cleanup and redevelopment of contaminated properties and sites. The regulations set forth the required application process for eligible facilities and include provisions for minimizing future liabilities for innocent landowners that meet state requirements.

Administration and enforcement. DES's Waste Management Division administers and enforces the New Hampshire Brownfields Program. DHHS assists DES by reviewing risk assessments for proposed projects. DOJ issues covenants not to sue to eligible persons.
