Rules. Pennsylvania has adopted the federal closure and post-closure rules for hazardous waste treatment, storage, and disposal facilities (TSDFs) but has substituted its own rules in connection with certification of closure, certification of completion of post-closure care, and financial responsibility. In addition, the state assesses closure fees.

Administration and enforcement. DEP's Bureau of Waste Management administers and enforces the TSDF closure and post-closure requirements in Pennsylvania.

State Requirements


25 PA Code 264a.166 and 25 PA Code 265a.166

Owners and operators must submit a request for closure or post-closure certification in accordance with the federal rules. Within 60 days of receiving the request, DEP will initiate an investigation of the facility to determine if closure or post-closure was carried out in accordance with the approved plan.
