Comparison: State vs. Federal

· Rules. South Dakota has adopted by reference the federal hazardous waste container requirements, including the empty container standards and the organic air emissions standards. Similarly, the state requirements for generators using containers to accumulate hazardous waste on-site without a permit follow the federal rules. There are no additional state provisions.

· Administration and enforcement. DENR’s Waste Management Program administers and enforces the container rules in South Dakota.
