Comparison: State vs. Federal

Rules. Virginia adopts by reference the federal requirements for managing hazardous waste containers, which include empty container standards, organic air emissions standards, and standards applicable to owners and operators of hazardous waste treatment, storage, and disposal facilities (TSDFs). TSDFs that use hazardous waste containers for storage or treatment must comply with additional state requirements in connection with permits, fees, and facility location. These additional state standards are reviewed in the state section TSDF PERMITS.

In addition, Virginia adopts by reference the U.S. Environmental Protection Agency's (EPA) Hazardous Waste Generator Improvements Rule, effective on the federal level as of May 30, 2017, and effective in Virginia as of April 8, 2018, which includes standards for generators accumulating hazardous waste on-site in containers.

Administration and enforcement. The Virginia Department of Environmental Quality's (DEQ) Division of Land Protection and Revitalization administers and enforces the container rules for hazardous waste TSDFs and generators in Virginia.
