Comparison: State vs. Federal

Rules. The federal containment building rules are in effect in New Hampshire. There are no additional state provisions.

Administration and enforcement. The containment building rules are administered by the federal EPA because, although EPA has authorized DES to enforce the state's hazardous waste management rules, New Hampshire has not yet incorporated these rules into its hazardous waste management program. Until DES adopts these federal rules, or more stringent state standards, EPA's Region 1 office will enforce the containment building rules in New Hampshire.
