Rules. Kansas has not adopted the federal regulations for delisting a hazardous waste under the federal Resource Conservation and Recovery Act (RCRA). Facilities must petition EPA Region 7 to delist, or exclude, a waste from the hazardous waste list. See the national section LISTED WASTES for additional information.

Delisting petitions are requests for variances that are waste and site specific. The delisting applies only to the specific waste generated by the specific facility covered by the petition. See the national section DELISTING PETITIONS for requirements and other guidance.

Administration and enforcement. EPA Region 7 is responsible for administering and enforcing the rules for hazardous waste delisting petitions in Kansas.
