Comparison: State vs. Federal

Rules. Utah has adopted the U.S. Environmental Protection Agency's (EPA) Hazardous Waste Generator Improvements Rule, effective in Utah as of August 31, 2017. Utah follows the federal requirements for making hazardous waste determinations, including the federal conditional exclusions from the definitions of solid and hazardous waste as they apply to cathode-ray tubes and solvent-contaminated wipes, the exclusion from the definition of solid waste for recycling certain hazardous secondary materials, and the hazardous waste exclusion for carbon dioxide streams in geologic sequestration activities.

Administration and enforcement. The Utah Department of Environmental Quality's Division of Waste Management and Radiation Control administers and enforces the state's hazardous waste determination rules.
